Requirements :

REQUIREMENTS: Grade 12 plus an undergraduate qualification (NQF level 7) in Legal/ Law (LLB) or relevant qualifications as recognised by SAQA. A minimum 5 years of experience at a middle management level in Legal Services environment in the Public Service. Five (5) years post admission experience as an Advocate or Attorney with the right to appear in the High Court. A valid driver’s license.

COMPETENCIES: Strategic Capacity and Leadership skills, People Management, Empowerment and Integrity, Financial Management, Change Management, Programme and project Management. Technical Competencies: Advanced financial and analytical skills and innovativeness. Adequate financial management and extensive knowledge of Supply Chain Management in the Public Service. Strong managerial and communication skills (written and verbal). Thorough knowledge of the Financial Prescripts of the Public Service and Supply Chain Management. ATTRIBUTES: Good interpersonal relations. Ability to work under pressure and meet deadlines. Ability to work in a team and independently. Strong Management skills. Problem Solving and Analysis, Client Orientation and Customer Focus, Communication.

Duties :

Provide legal advice on the development, management, breach of contracts and review of Departmental Contracts. Draft Departmental contracts, Service Level Agreement and other legally binding agreements. Provide legal advice to the Department on legal recourse arising from contracts and agreements. Scrutinize legal documents providing basis for litigation. Seek legal advice from the State Attorney in the establishment of legal advice on matters for and or against the Department. Defend legal rights and interest of the Department in litigation. Provide Legal reports on litigation cases against the Department. Manage the compilation and submission of legal reports, documents to oversight committees. Scrutinize and provide input to legislative and policy documents binding to the Department. Establish Department’s legal obligations, rights, implications and recourse on legislative and policy matters. Prepare and Provide reports on legal opinions. Administration of Appeals as prescribed in the NEMA Regulation. Reviewing of appeals recommendation from the Appeals Advisory Panel. Ensure that all information /documents pertaining to the appeal process are compliant with necessary legislation frameworks. Provide legal advise to the MEC on appeal matters as prescribed by NEMA Regulations. Manage Directorate’s budget and expenditure. Manage the Directorate’s performance. Manage staff performance, development, leave and discipline. Provide pro-active legal services to prevent non-compliance by the Department to Legislative framework. Advise the Department on Labour matters before Labour Courts.
